SPECIAL INDEPENDENT PROSECUTOR PANEL.


LEGAL AUTHORITY

Act 2 of February 23, 1988, as amended, created the Special Independent Prosecutor Panel and the position of Special Independent Prosecutor. Reorganization Plan No. 1 of January 3, 2012 dissolved the Comission to Hear Municipal Complaints and transferred its faculties, functionalities and duties to the Panel and the Commissioner of Municipal Affairs. The Panel will have jurisdiction to view and resolve complaints or charges formulated against any Major.

PROGRAM

Investigation and Prosecution of Officials Involved in Criminal Conduct

Program Description

Designates special independent prosecutors to conduct all types of investigations related to individuals included in Section 4.1 of Act 2, supra, as well as entities, documents related to its jurisdiction or assignments delineated by the Panel. In addition, request protection orders from the Courts to prohibit any conduct that can affect a witness. Files accusations and processes pertinent lawsuits within thirty days of completing the investigation. Also, prepares impartial and final reports.

Disciplinary and Administrative Unit

Program Description

Recommends actions related to disciplinary procedures against Mayors when: a cause for arrest has been identified or if convicted or if there are reasons to conduct a special investigation related to the Mayor's harmful conduct.

FISCAL YEAR 2012-2013 PROPOSED BUDGET

The proposed consolidated budget for Fiscal Year 2012-2013 ascends to $2,859,000 from the Joint Resolution - General Fund.

Operational Expenses reflect an increase of $795,000 when compared to funds assigned in fiscal year 2011-2012. These funds will be used to meet what was established by Reorganization Plan No. 1 of January 3, 2012, which created the Disciplinary and Administrative Unit. Additional funds are included to cover the Panel's operational costs.

In accordance with Act. No. 2 of February 23, 1988, as amended, The Special Independent Prosecutor Panel will submit its funding request directly to the Legislative Assembly.

The Municipal Complaints Hearings Program was functional until Fiscal Year 2011 as a component of the Commission to Hear Municipal Complaints, which was disbanded through the Reorganization Plan No. 1 of January 3, 2012.
