LEGAL AUTHORITY

Act. No. 45 of April 18, 1935, as amended, known as the Workers Accident Compensation Act created the Industrial Commission.

MISSION

Guarantee rehabilitation, medical/hospital treatment and a fair and reasonable economic compensation to injured workers through the State Insurance Fund Corporation, as well as guaranteeing insured employers in Puerto Rico correct premium rates, insurance and accident coverage, and revisions in accordance to law.

PROGRAM

Evaluation and Adjudication of State Insurance Cases

Program Description

The Commission adjudicates according to work related accident compensation law the appeals conducted by injured workers and the employers that understand that they have been affected by a decision made by the State Insurance Fund Administrator. In addition, the Program must adjudicate those employee/employer controversies under its jurisdiction.

FISCAL YEAR 2012-2013 ADOPTED BUDGET

The adopted consolidated budget for Fiscal Year 2012-2013 is $24,090,000 from Other Income. Other Income is generated from occupational medical insurance premiums as established by Act no. 45 of April 18, 1935, as amended, known as the Workers Accident Compensation Act. This act establishes that up to 4% of these premiums can be used to pay operational expenses. In addition, it establishes that the State Insurance Corporation will be responsible for collecting the premiums and transferring the budget as approved by the Legislative Assembly.

Operational expenses reflect a decrease of $1,908,000 when compared to funds assigned in fiscal year 2011-2012. The Commission estimates a reduction in primiums collection, thus lowering the assigned amount.

The adopted budget will allow the Commission to comply with the duties established by its Organic Law: review the decisions made by the State Insurance Fund Corporation, ensure injured workers are receiving the services to which they are entitled to, as well as, adequate medical treatment and fair and reasonable compensation.
